Today, again none has come present on behalf of the complainant nor reply to the application of Opposite Party No.3 filed. Perusal of the record shows that from the last nine hearings, none has come present on behalf of the complainant. However, in the interest of justice, the matter was being adjourned time and again. Perusal of the record further shows that opposite party no.3 moved an application for appointment of an independent expert to ascertain the actual defect, if any in the produce, but till date neither complainant appeared in person nor reply to the application filed. On the last date of hearing, the case was adjourned for filing the reply, subject to payment of costs of Rs.1000/-, but today again none has come present on behalf of the complainant

          Not only this, written intimation was also sent to complainant, which was duly received by the complainant on 21.02.2022, but the complainant did not pay any heed to the written intimation also.

          It is presumed that the complainant is not interested in prosecuting his case and hence the instant complaint is dismissed in default for want of prosecution. Copy of the order be supplied to the parties, free of costs and thereafter the file be consigned to record room.
