Sh. Ashutosh Aggarwal, Adv. has filed power of attorney on behalf of Op No.1.  Today the case is fixed for filing reply by the Ops being last opportunity.  But the counsel for OP No.1 has brought into notice of the Forum that the complainant has already settled  the matter vide Memorandum of Settlement dated 04.10.2014  after filing  of the present case  whereby he has been provided  with a new DPA set having IMEI No.353267065134908 and in the aforesaid settlement, the complainant has also undertaken that he will place the aforesaid settlement before the Forum on the next date of hearing being ‘out of court settlement’ but till today neither the complainant nor his counsel has brought this fact to the notice of the Forum rather concealed it.  

                        Hence, in view of the memorandum of settlement (Annexure R-1) placed on record by counsel of Op No.1, present complaint is disposed of being fully satisfied.  Copies of this order be sent to parties concerned, free of costs, as per rules.  File be consigned to record room after due compliance.
