From the track report it is found that service of notice upon OP no. 1 could duly be effected on 21.01.2023. But he has not entered appearance so far. But he will get time to file W/V.

As such, 21.02.2023 is fixed for filing W/V by OP no. 1.

The Ld. Advocate of OP no. 2, the Ld. Advocate of the complainant, the Ld. Advocate of OP no. 3 and 4 are present.

The MA/268/2022 is taken up for hearing. After hearing the aforesaid Ld. Advocates we find that the son of OP no. 2 who is also a necessary party in this case could not be included in the complaint due to inadvertent. It is clarified by the Ld. Advocate of the complainant that he could not know that OP no. 2 had any son in the name of Roni Mitra. The presence of Roni Mitra according to him, is essentially required for effective disposal of the case. Therefore, the MA/268/2022 which has been filed for bringing Roni Mitra into this record is allowed. The Ld. Advocate is directed to file amended complaint incorporating the name of Roni Mitra by the next date. He will also issue notice to Roni Mitra and asking him to appear before this Commission on 21.02.2023 and to file W/V within 30 days from the date of receipt of the notice.

The MA/268/2022 is thus disposed of.
