JUDGMENT
The facts of the complaint in brief is that the complainant has purchased one mobile phone Lava Irish XI Guard Vide Case memo No.815, on dt: 02.07.2015 from the authorized dealer O.P.No.1 with a consideration of Rs.6,500/-. But to his utter surprise within four months of its purchase the set started trouble and did not function properly and immediately the complainant approached the O.p No.1 but the O.P 1 requested to approach the service centre at Rayagada. On the request of the O.p 1 the complainant approached the O.p 3 to rectify the defect . The complainant approached the O.p 3 number of times but there was no positive action and as such the complainant was caused mental agony and financial loss and finding no other option has approached this forum for relief and prayed to direct the O.Ps to replace the defective mobile set with a new one and pay compensations for mental agony
On being noticed by this forum the opposite party No.2 and 3 appeared and file their counter stating their in that, there is no deficiency in service on the part of the Ops. As the complainant has not approached the proper quarter of hand set in question or authorized service centre of the product for alleged redressal repair of the defect in the hand set. Hence, the present case is to be dismissed against the above Ops. The Op No.1 remained

silent and did not turn of to file any written version. In absence of any written version from the opposite party No.1 we proceeded the matter exparte and believed the allegations of the complainant and hence, we passed the order and dispose of the matter with the following directions.
ORDER
The Opposite Parties are directed to replace the mobile set of the same model with fresh warranty or refund the amount of the mobile phone Rs.6,500/- within one month from the date of receipt of this order, failing which the complainant has liberty to file execution proceeding U/s 27 of the C.P Act,1986. Pronounced in open forum today on this 19hday of March,2016 under the seal and signature of this forum.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge.
