1.         This is an appeal preferred by the complainant against the order of dismissal for his absence on 19.03.2010. 

2.         The complainant alleged that he could not file the affidavit evidence on the ground that his counsel informed the date by mistake as 29.03.2010 instead of 19.03.2010.  This fact is not controverted.  In the light of the plea taken by the complainant in this regard, we are of the opinion that one more opportunity could be given to him.  However, in view of latches on costs of Rs.200/-.  Costs paid. 

3.         In the result, the appeal is allowed and the order of the District Forum is set aside.  The District Forum is directed to restore the complaint to its original file and direct the complainant to file his affidavit evidence and after giving opportunity to both parties dispose of the matter as per law.  Both parties are directed to appear before the District Forum on 30.08.2010 without insisting for fresh notice.
