F I N A L    O R D E R

This complaint is filed by Hestin Hess, S/o. Francis K.J., Kaimathuruthy House, Thuruthoor, Puthenvelikkara alleging deficiency of service and unfair trade practice from the side of opposite party. The complainant filed the instant complaint on 26/02/2019 and the notice was sent to the opposite party on 17/12/2019 from the Commission. Complainant appeared before the Commission only on 03/01/2020 and 16/02/2022 and thereafter he had not turned up to conduct the case. Eventhough it was tried to contact the complainant over phone and e-mail on different dates from the Commission, the complainant had not turned up or attended the call and therefore all the efforts were in vain to contact the complainant. Finally the complaint is taken for order on merit on 27/06/2024.

In this case opposite party filed their detailed version through their counsel and in the absence of complainant to conduct the case and also since the complainant had not filed the proof affidavit the Commission has verified the following points:

  1. Whether the complainant is sustained to any sort of deficiency of service, or unfair trade practice from the side of the opposite party?
  2. Whether the complainant is eligible to get any relief from the opposite party?
  3. Cost of the proceedings if any?

Complainant has failed to prove the case on merit and since no proof affidavit is filed and also since the complainant had not turned up to conduct the case Point No. 1 is proved against the complainant and therefore the complaint is dismissed.
