ORDER NO. 11 DT. 27.1.10

M.A. 214/09

We have considered the application for clarification of the order passed by this Commission on 27.8.08.  On perusal of the said order it appears that the Appeal was dismissed under the circumstances then prevailing.  As the grievances of the present Petitioner in M.A. 214/09 had been stated in the old Appeal preferred by the Petitioner/Appellant in Appeal Case No. FA/08/76, which was disposed of long back on 27.8.08, there is no question of clarification as asked for because the Appeal having been dismissed there is no scope of further clarification at this stage and any grievance of the petitioner regarding the execution petition may be brought to the notice of the Executing Forum.  With the above observation the application is dismissed.

Mr. Brahmachari, Ld. Advocate, appears for the Respondent.  But as it appears that the original Respondent is dead, the present Vokalatnama filed on behalf of the husband of the deceased is not accepted because the the husband is not a party in the proceeding.
