Today is fixed for adducing evidence by the complainant or filing settlement paper by the parties.  The complainant files hazira.  On behalf of the O.Ps. hazira along with a banker’s cheque for Rs.1,44,828.98 bearing No.158249 dated 30.09.2016, drawn on Axis Bank Ltd., has been filed.  Let the same be kept with the record.

Let banker’s cheque as mentioned above be kept in safe custody of this Forum for handing over the same to the complainant as said cheque has been drawn in the name of the complainant.

The Ld. Advocate for the complainant has moved the petition dated 27.9.2016 filed on behalf of the complainant.  The copy of the said petition was duly served upon the O.Ps.

By filing this petition dated 27.9.2016 the complainant has stated that the dispute involved in this case has been settled out of Forum and as such he is not willing to proceed with this case further and has prayed to dismiss of the case for non-prosecution.  The petition is taken up for hearing.  Heard both the sides.  The Ld. Advocate for the O.Ps. has raised no objection. 

In the above premises there is no bar to allow the petition filed on behalf of the complainant on 27.9.2016. 

Fees paid is correct.  Hence, it is

Ordered

that the petition dated 27.9.2016 filed by the complainant, is allowed.  Accordingly, the case is dismissed for non-prosecution without any cost. 

Let the copies of this order be supplied to the parties free of cost.
