ORDER

 

 The complainant has made the following prayer:

  1. Direct the respondent No. 1 to handover physical possession of plot No. F-49, Sonipath Global City, Haryana to the complainant.
  2. Direct the respondent No. 1 to pay a sum of Rs. 5,00,000/- towards rent paid by the complainant due to non-handing over possession of the plot in question.
  3. Direct the respondents to pay the sum of Rs, 5,00,000/- towards mental and physical harassment as well as for deficiency in service to the complainant.
  4. Director Respondent No. 1 sum of Rs. 2,06,028/- alongwith interest @ 18% P.A. towards aggrieved compensation for delay in handing over the possession of plot in question to the complainant.
  5. Direct respondent No. 1 to pay EMI of Rs. 10,697/- with effect from July 2016 onwards alongwith penalty if any to the respondent No. 2 for the loan obtained by the complainant.
  6. Award a sum of Rs. 50,000/- towards cost of litigation.
  7. And, may pass such further orders as this Hon’ble forum may deems fit and proper in the facts and circumstances of the case.

 

Section 11(1) of the Consumer Protection Act, 1986 reads as under :-

          

           “Subject to the other provisions of this Act, the District Forum shall have jurisdiction to entertain complaints where the value of the goods or services and the compensation, if any, claimed (does not exceed twenty lakhs).”

 

In the present complaint, the complainant in the prayer clause no ‘a’ has prayed for the possession of the plot worth Rs.19,54,498/- besides the other relief against the OPs, the total prayed claim is beyond the pecuniary jurisdiction of this Forum as it exceeds Rs. 20,00,000/-.

Under these circumstances the complaint be returned to the complainant/Counsel for the complainant being beyond pecuniary jurisdiction for filing it before the appropriate Forum having jurisdiction and a copy of the complaint be retained for records.  Office to comply the orders and the file be consigned to Record Room.
