.       Today is fixed for order in respect of withdrawal petition filed by the complainant on 18.6.2019. Complainant is present today by filing agent hazira. He also filed Xerox copy of Aadhar card being identified his Ld Advocate. The complainant in his petition stated that he filed a complaint petition against the opposite party before this Forum alleging that being aggrieved at the illegal and arbitrary act of the opposite party in respect of handing over the possession of the flat as described in the complaint petition. During the pendency of the complaint petition the complainant filed the instant petition to withdraw the case being No.47 of 2018 as the grievances of the complainant has been settled out of court and the opposite party handed over the alternative flat and registered the same in favour of the complainant. So the complainant does not want to proceed with the case and prayed to dismiss the case due to non prosecution.

Heard the complainant and perused the case record it appears that complainant is not interested to proceed with the case and prayed to withdraw the same as the dispute has been settled amicably. As such the Forum may not cause impediment at the pious act of the complainant.   

ORDER

Hence ordered that the complaint petition being No.47 of 2018 be and the same is dismissed due to non prosecution.

Let a plain copy of this order be supplied free of cost to the parties/their Ld. Advocates/Agents on record by hand under proper acknowledgement/ sent by ordinary post for information & necessary action.
