     This is an appeal filed  by the appellants/complainants under Section 15 of the Consumer   Protection Act,1986 to modify the   order of the District Forum,  Warangal in C.D.No.30/2004 dt. 9.11.2004   by  granting  the reliefs as prayed for

 

      The  Appellants herein are the complainants before the District Forum. They filed complaint under Section 12 of the Consumer Protection Act,1986 to direct  opp.parties to  pay compensation of Rs.10 lakhs  together  with interest at 12 percent p.a.  to the complainant and to award costs of the complaint .

 

The case of the complainant is as follows-

       The 1st complainant is the widow and complainants 2 and 3 are the minor children of the deceased Raavi Rama Krishna Reddy .  The husband of the 1st complainant met with an accident on 28.3.2002  at about 2.45 p.m.  while going on his scooter near Jangaon and sustained injuries and was admitted in the opp.party hospital on the same day.   and the doctors  of the said hospital performed Craniotomy on him . During the treatment the  health condition of the  husband of the complainant was worsened day by day  and ultimately   died on 4.4.2002   The postmortem examination on the body of the deceased revealed that he also sustained fractures of his ribs resulting in  laceration of the left lung which was also one of the causes of the death of the deceased.  During   the treatment of the deceased at the hospital of the opp.party no attention was given to the injuries caused to the  ribs or to the lungs which being one of the causes for the death of the deceased.  The complainant issued a legal notice to the opp.party  for which the opp.party gave reply denying all the facts of the case.
