During the course of proceedings, Counsel for the Opposite Party No.3, Sh.Aditya Jain, Advocate got recorded his statement that the opposite party No.3 is ready to pay Rs.4000/- as cost of mobile hand set to the complainant, subject to return of original mobile set along with its accessories on the condition that mobile hand set is not water damaged. The complainant got recorded her statement that she is ready to compromise with the opposite party No.3 and is ready to accept the offer given by counsel for the opposite party no.3 to pay Rs.4000/- in lump sum as cost of mobile hand including compensation and litigation expenses. She further undertook that mobile hand set is not water damaged and further undertook to return the original mobile set alongwith all accessories at the time of receiving the cheque from counsel for the opposite party No.3. In view of aforesaid statements of counsel for the Opposite party No.3 as well as complainant, the present complaint is disposed of with direction to the complainant to return the original mobile hand set along with its accessories to counsel for the opposite party No.3 and the opposite party no.3 is directed to pay Rs.4000/- in full and final settlement of the claim of the complainant within one month from the date of receipt of copy of order. Copy of this order be supplied to the parties, free of costs, under the rules. File be consigned to the record room.
