ORDER

          In nutshell complaint case is that he had purchased one Fiber Khetan Cooler for the sum of Rs.9000/- on 16.5.2012 from the Op. Op warranted its motor for two years and body for seven years. As alleged, there was some problem of leakage after six months and on complaint, the Op get repaired the body. Now, within the valid warranty of seven years, body damaged badly, but despite repeated requests, op did not hear the genuine request of the complainant rather misbehaved with him. Hence, this complaint.

2.                On notice, OP failed to appear before the Forum despite servive and accordingly, he was  proceeded exparte vide order dt. 25.7.2016.

3.                In exparte evidence, the complainant produced his affidavit Ex. C1and  photo copy of bill Ex.C2.

 4.               Heard. Complainant proved his allegations by way of his affidavit Ex.C1. Warranty of the body for the period of 7 years is also proved on record through bill Ex.C2, whereas there is no version from the Op despite of notice and proper service. In these circumstances, we have no other option except to allow the present complaint. Accordingly, present complaint is allowed and OP is hereby directed to refund the price of the Cooler i.e.Rs.9000/- to the complainant within a period of one month from today. Copy of this order be supplied to the parties as per rules. File be consigned to record room.
