J u d g e m e n t.
The present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non refund of purchase price a sum of Rs. 1,900/-. The brief facts of the case has summarised here under.
That the O.P. No.1 is manufacturing and marketing its product SWEAT SLIM Belt for removal of the colesteral and it is to be tied in the waist of the persons for certain minutes. As per his Advertisement the said product is giving much relief to the persons who wanted to remove the colestral and also given wide publicity about its benefit etc. The complainant has intended for 2(two) belts and made a telephone call to the O.P. No.1 on Dt. 16.8.2016 and immediately he has sent the same to the O.P. No. 2 who is the dealer of the said product at Bhubaneswar. The O.P. No. 2 immediately sent the said product through courier service who delivered the item on 7.8.2016 next day at 11 A.M. and the complainant has paid a sum of Rs. 1,900/- towards the cost of products. The said parcel was opened and the complainant wanted to use the same and when it had tied to his waist the left side and right side of the said sweat slim belt gave tearing and when another belt was used by his wife it has enlarged and absolutely it has no use and it has not shown any such miracle as advertised by the O.P. No.1 and immediately the complainant has contacted his customer care No. and he has asked to contact O.P. No.2 but he has refused to take back the same. The O.Ps had not given any warranty or guaranty against the said products only to fool the customers they are making such advertisements. The order was booked to the O.P. No.1 on Dt. 6.8.2016 and the O.P. No.2 is able to sent the item to reach the customer by 7.8.2016. So this is a net work of fraud played by the O.P. No. 1 and O.P. No.2 regarding the fraud products manufactured by the O.P. No.1. The complainant prays the forum to direct the O.Ps to refund the purchase price a sum of Rs.1,900/- and for causing the mental agony and sufferings a further compensation of Rs.2,000/- be awarded along with legal expenses and such other relief as the hon’ble forum deems fit and proper for the best interest of justice.
2. This forum had sent notice to the O.P. by Regd. Post for appearance before the forum and defend the case. The O.P. refused the same to receive as remark recorded by the postal authority in the Regd. Cover. The service is sufficient. Hence the O.P. was set exparte on to close the case in time bound according to the C.P. Act.
3. During the exparte hearing the complainant examined himself and proved the payment of the money to the O.Ps. The complainant also argued due to non repalcement of the above set the complainant suffered a lot of financial trouble and mental agony. The complainant prays the forum as the O.Ps not heard any grievance of the complainant till date so the O.Ps be directed to refund purchase price along with bank interest.
In the absence of any denial by way of written version from the side of the O.Ps. it is presumed that the allegations levelled against the O.Ps. deemed to have been proved. The complainant had paid the amount for the good service as per warranty card which intended with the O.P and the said payment is made for the consideration for the said service. When the O.Ps have failed to give such service as per warranty card for which the O.Ps have received the amount. It is deemed that the O.Ps were callous to the allegations and it amounts to deficiency of service.
In the present case the O.Ps . are jointly and several liable.
Hence to meet the ends of justice, the following order is passed.
ORDER.
4. In the result with these observations, findings the complaint petition is allowed in part on exparte against the O.Ps
The O.Ps are ordered to take back their product and refund price of the SWEAT SLIM Belt a sum of Rs. 1,900/- to the complainant. The O.Ps. are further ordered to pay Rs.1,000/- towards litigation expenses to the complainant.
The O.Ps are ordered to comply the above direction within 45 days from the date of receipt of this order. Serve the copies of the order to the parties.
