ORDER

1. The present appeal has been preferred by opposite party No.1 i.e. M/s Reliance Retail Limited, BMG Mall Circular Road, Rewari for challenging the order dated 29.02.2024 passed by the District Consumer Disputes Redressal Commission, Rewari whereby complaint preferred by the complainant was allowed. For ready reference, operative part of the impugned order is as under:

“….the present complaint is allowed against the opposite parties whereby both of them are jointly and severally held liable to refund price of laptop of Rs.64999/- , within 45 days from today to the complainant, subject to return of the defective laptop, along with simple interest @ 9 % per annum from the date of filing of complaint till realization, within 45 days from today, failing which the said amount shall fetch interest @ 12% p.a. from the date of filing of the complaint till realization. . Complainant is also allowed compensation of Rs. 15,000/- on account of mental agony , harassment and litigation expenses which be also paid to complainant within the above stipulated period of 45 days from today, failing which the said amount shall also fetch simple interest @ 9% p.a. from the date of filing of the complaint till realization.”

2. Counsel for the appellant states that opposite party No.2 i.e. M/s Asus India (respondent No.2 herein) has since paid the entire awarded amount along with interest to the complainant and in view of the aforesaid development, the appellant wants to withdraw the present appeal.
3. Shri Shiv Kumar, proprietor of respondent No.1, who has appeared in person confirms the aforementioned factum of paying the entire awarded amount along with interest to the complainant and, accordingly, he has no objection, if, the appellant is allowed to withdraw the present appeal.
4. In view of the above, the appeal is hereby dismissed as withdrawn.
5. Application(s) pending, if any, stand disposed of in terms of the aforesaid order.
6. The statutory amount of Rs.44,635/- deposited by the appellant while filing the appeal be refunded to the appellant against proper receipt and identification but in accordance with rules.
7. A copy of this order be provided to the parties free of cost as mandated by the law. The order be uploaded forthwith on the website of the Commission for the perusal of the parties.
8. File be consigned to record room along with a copy of this order.
