Final Order / Judgement

Today Dr. N.K. Safaya, President of Shivalik Green Apartment Resident Welfare Association (RWA) – complainant as well as Sh. Yogendra Lumba - partner and authorised signatory of M/s J.J. Build Tech for opposite party Nos. 1 & 2 has appeared.

Both the parties have arrived at a compromise (paper No. 193 & 194) and submitted the same before us.

The above compromise has been explained and read over both the parties alongwith witness Dr. Nootan Smriti and Sh. Dharan Singh. All have admitted the terms and conditions of the compromise.

The parties are identified by their counsel concerned with the ID.

Both the parties of the complaint case and their counsel have admitted the terms and conditions of the compromise, hence the said compromise is hereby admitted and kept on record.

The complaint case is hereby decided according to the compromise and the compromise shall form part of the decree. No order as to costs of the complaint case.

The opposite parties are directed to comply the terms and conditions Nos. 1 to 5 of the said compromise within three months from today, i.e. 16.09.2023, on failure of which the complainant shall be entitled to execute the conditions of the settlement through the court by filing the execution as well as opposite parties shall also pay Rs. 5,00,000/- (Rupees Five Lacs only) to the complainant for non-compliance of the above mentioned conditions of the compromise.

                    File be consigned to the record room alongwith copy of this order.
