ORDER

            Counsel for applicants-OP No.4 & 5 moved the present application for refund of the amount of Rs.48,345/-. It has been stated in the application that the complaint has been decided by this Forum on 21.10.2009. Against the said order, an appeal was preferred by the applicants-OP No.4 & 5 wheriny the Hon’ble State Commission vide its order dated 2.12.2009 had been pleased to stay the operation of award subject to depositing of 50% of the total amount and in compliance thereof, the applicants-OP No.4 & 5 deposited an amount of Rs.48,345/- by way of cheque No.363572, dated 8.1.2010 favouring the President, District Forum, U.T. Chandigarh. It has been further stated that the appeal No.659 of 2009 has since been ordered to be dismissed qua the applicants-OP No.4 & 5, therefore, amount of Rs.48,345/- lying deposited with this Forum, may be ordered to be released to the applicants-OP No.4 & 5.

2.                     Sh.Balwinder Singh, Counsel for respondents-complainants has not opposed the application vide his statement recorded on the application itself. The office has reported that Rs.48,345/- deposited in DF-I account vide cheque No.363572, dated 8.1.2010 on 14.1.2010.

3.                     Accordingly, the office is directed to issue a cheque of Rs.48,345/- in favour of National Insurance Company Limited – applicants/OP No.4 & 5 and the same be handed over to them or their counsel against proper receipt and as per rules. The application stands disposed of accordingly.

4.                     Copies of this order be sent to the parties free of charge. Be tagged with the main complaint.
