Complaint under section-12 of Consumer Protection Act, 1986

Now  amended  Section 34 of Consumer protection Act 2019.

ORDER:  

                   Today the case was fixed for filing reply the application filed by the opposite party for dropping the proceedings of the complaint since become infructuous.

2.                          Instead of filing reply to the application, counsel for the complainant has made a statement that “I have received claim amount of Rs.2,54,200/- in full and final settlement through NEFT dated 12.09.2022, Federal Bank, Sector-16, Faridabad and now I press only litigation and harassment charges.

3.                          On the basis of the statement of Shri Ravinder Nagar, counsel for the complainant, the Commission is of the opinion that  the complaint was filed in July  2022 and the payment made on 12.09.2022.   Opposite party has harassed the complainant mentally.  Hence, opposite party is negligent on their part.  Deficiency of service is proved. . Hence the complaint is disposed off qua the harassment & litigation charges.

4.                          Opposite party is directed to pay Rs.5500/- as compensation for causing mental agony and harassment. Opposite party is also directed to pay Rs.5500/- as litigation expenses to the complainant. Compliance of this order  be made within 30 days from the date of receipt of copy of this order.  Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
