ORDER:
Today the case was fixed for arguments.
Instead of arguing the case, Sh. Rakesh Dabaas, counsel for the Op no. 1 has suffered a statement that “ I being the authorized representative of M/s ICICI Lombard Insurance Company Limited, am ready to settle the present matter for total amount of Rs.3,45,000/- in full and final settlement towards the claim of the complainant involved in the present matter subject to deposition of salvage of car no. HR-29-AS/5527 by the complainant. I have received NOC and cancellation of RC from the complainant today. A period of 60 days may be given to make the payment of said amount by the insurance company. “
On the other hand, Sh.Mahesh son of Sh. Satbir, R/o village Jawan, Tehsil Ballabgarh District Faridabad alongwith Sh. Jagdish Bidhuri, Advocate has suffered a statement that “ we have heard the statement of counsel for Insurance company. Offer acceptable by us and on behalf of the complainant so as to settle the matter for Rs. 3,45,000/- in full and final settlement towards the claim of the complainant in the present matter. Salvage of the car in question shall be handed over to the insurance company within a week. Complaint may kindly be disposed off accordingly.”
2. On the basis of the statement of the parties, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party No.1 to pay an amount of Rs.3,45,000/- in full and final settlement towards the claim of the complainant involved in the present matter, subject to deposition of salvage of car no. HR-29-AS/5527 by the complainant. Compliance of this order be made within 30 days from the date of receipt of copy of this order. File be consigned to the record room.
