The learned counsel for the respondent drew our attention to a letter dated 13-10-2009 stating that there was settlement of dues of ICICI Credit Card Account No.44774600031430004 wherein the respondent/complainant signed and agreed to withdraw the appeal. The learned counsel for the respondent also filed a memo stating that the appellant herein settled the matter with the respondent and as such the appeal may be dismissed as settled out of court.
In view of the memo filed by the respondent, the appeal is dismissed as settled out of court. There shall be no order as to costs.
