Bunch of complaints were filed by the complainants before the District Forum Behraich, UP against the respondent M/s Hind Cold Storage for deficiency in service for non-payment of the sale proceeds of the potatoes which were stored in the cold storage. The complaints were decided ex-parte. Aggrieved by this, petitioner filed an application for restoration of the complaint which was dismissed b the District Forum. -2- State Commission set aside the order of the District Forum and remanded the case to the District Forum with a direction to dispose of the complaints on merits after perusing the evidence. Complainants have filed the present revision petitions. Revision petitions were admitted and notices were ordered to be issued to the respondent. Notice sent to the respondent was received back unserved. On 24.10.2008, on a request made by the counsel for the petitioner, process was given to the petitioner to affect dasti service on the respondent. Petitioner was unable to affect dasti service on the respondent and moved an application for being discharged from the case. Application was allowed on 30.5.2008 and notices were issued for today hearing to both the parties. Inspite of service, neither the petitioners nor the respondents are present. Dismissed for non-prosecution.
