The Complainant is entitled to receive from the OPs a sum of Rs. 40,000/-  per month from 1/12/11 until such time the possession of the second flat is delivered to the Complainant, in terms of the first issue framed by the Lr. Arbitrator or such time the complaint is held not entitled to the said flat in view of the second issue, framed by thr Lr. Arbitrator.

In the circumstances, therefore, we direct the OPs to pay to the Complainant Rs. 40,000/- per month with effect from 1/12/11 till such time the second flat F-3 or some other flat is delivered to the Complainant or the complaint is held not to be entitled to the same by the arbitrator.

The OPs to make the said payment within a period of 30 days failing which coercive action will be taken against the OPs in MA No. 69/13.
