ORDER:
File taken up today on the application filed by the complainant for recording the statement.
Sh. Abhishek Kumar Jr counsel for Sh. O.P.Gaur, counsel for the Op no. 2 has suffered a statement that “ I being the authorized representative of HDFC Ergo Limited, I am ready to settle the present matter for total amount of Rs.5,00,000/- (five lacs) sum insured in full and final settlement towards the claim of the complainant. A period of 45 days may be given to make the payment of said amount by the insurance company. “
On the other hand, Sh. Manish Gupta, counsel for the complainant has suffered a statement that “I have heard the statement of counsel for Insurance company. Offer acceptable to me for and on behalf of the complainant so as to settle the matter for Rs. 5,00,000/- in full and final settlement towards the claim of the complainant in the present matter. Complaint may kindly be disposed off accordingly.”
On the basis of the statement of both the parties, the Commission is of the opinion that the complaint is disposed off with the direction to opposite party No.2 to pay Rs.5,00,000/- (five lacs) sum insured to the complainant in full and final settlement towards the claim of the complainant within 30 days from the date of receipt of copy of order. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
