S. Mohinder Pal Singh complainant has filed the present complaint under Section 12 of the Consumer Protection Act 1986 as amended upto date against opposite party i.e. Bharti Airtel Ltd. through M/s Guru Kirpa Tele links to claim monetary compensation on account of woeful deiciency in mobile service. 2. The brief facts in the complaint are that complainant obtained Airtel Post paid mobile No.98761 - 82887 and 98761-92887 by the opposite party. Being not satisfied with the services of M/s Bharti Airtel Ltd. through Cutomer Care Tele Links Kapurthala, he decided to change his billing plan. However on 18/2/2007 his balance mount due for mobile No.98761-82887 was Rs.368/-. He was promised a discount of Rs.200/- from his billing amount of Rs.368/-. He was told that new plan charges are Rs.500/- for one year which are to be paid with the bill of March 2007 and also promised discount of Rs.50/- per month and also waiver of caller ID charges every month in the new plan. Despite deposit of Rs.70/- he was told that his balance due on 18//2007 was Rs.99/- after discount of Rs.200/- and further to exempt late fee. He was told that bill amount will be around Rs.600/- ( Rs.500/- for new plan charges and Rs.99/- last balance but still he was harassed and put pressure to deposit balance amount of Rs.168/-. He received bill of Rs.1020/- from the office of opposite party without giving discount and imposing late fee thereto . Later on services on his mobile were terminated causing much mental torture. His mobile started working on 20/4/2007 but without the facility of outgoing calls and again he found that still a ablance of Rs.300/- standing in his account. He found that mobile services were again stopped on 25/4/2007. He gain visited office of Airtel and he was told to deposit the said amount and get the phone restored.. Hence this complaint for monetary compensation. 3. Opposite party failed to appear despite services and was proceeded exparte. 4. Complainant led exparte evidence by producing copies of documents Ex.C1 to C9 and his own affidavit Ex.C10. 5. We have heard complainant in person and perused the evidence. It is evident from the document dated 15/5/2007 Ex.C8 by Retention Executive Guru Kirpa Tele Links Kapurthala that complainant was restored mobile connection by the opposite party by giving the sim card free of cost to him in respect of mobile No. 98761-82887. Nevertheless complainant has suffered mental tension and physical harassment on account of unjust deprivation of mobile services for the period from 1/4/2007 to 20/4/2007 and then from 25/4/2007 to 15/5/2007. Complainant has also reiterated allegations of deficiency in service vide his own affidavit Ex.C10. Therefore, considering the unrebutted ocular as well as documentary evidence on the record, we are of the considered opinion that opposite party has committed deficiency in mobile services and as such we pass exparte order directing the opposite party to pay monetary compensation of Rs.5000/- and further cost of litigation of Rs.2000/- to the complainant within a period of one month from the receipt of copy of this order otherwise it be recovered in accordance with law. Let certified copies of judgment rendered be supplied/despatched to the parties without any unnecessary delay and thereafter file be consigned to record room.
