The present Revision Petition as well as First Appeal No.273/2006 were disposed of on 27.10.2009 in the presence of counsel for the respondent.  We had reviewed our order in the present Revision Petition vide our order dated 12.2.2010 and directed that notice be issued to the counsel for the respondent.  Counsel for

the respondent is not present despite service.  Respondent is ordered to be proceeded ex-parte.

We had disposed of the First Appeal No.273/2006 as well as the present Revision Petition by a common order.  We had allowed the First Appeal No.273/2006 filed by the petitioner and remitted the case back to the State Commission for a fresh decision in terms of the directions issued.  Instead of allowing the Revision Petition as well, which has also been filed by the petitioner, we had directed that the same has become infructuous and disposed of as such.

For the reasons stated in our order First Appeal No.273/2006 dated 27.10.2009, this Revision Petition is allowed in the same terms.
