          Complainant files a petition which is treated as M.A. 79/2023. The M.A application is taken up for hearing. The complainant stated that he has came to know from the written version filed by the O.P. Nos.1 and 2 that the O.P. No.3 namely Smt. Snigdha Paul partner of the O.P. No.1 has died. The O.P has filed a Miscappeal vide No. 50/2022 before the Ld. 4^th FTC at Barrackpore wherefrom it came to notice to the complainant that O.P. No.8- Sarmila Acharya has also expired leaving her heirs as Sumit Acharya, S/o. O.P. No.8. In the circumstances the complainant wants to expunge the name of Snigdha Paul. The complainant also prays for substituting the O.P. No.8- Sumit Acharya in place of Sarmila Acharya as her legal heir.

          The petition filed by the complainant is heard, considered and allowed.

Hence,

                      It is Ordered,

that the O.P. No.3 of this case is expunged and the name of Sumit Acharya is substituted in place of O.P. No.8- Sarmila Acharya, since deceased.

          The complainant is directed to file amended complaint and takes steps according to law.

          The M.A. 79/2023 is allowed.
