Present:           Complainant in person.

Opponent No.1 ex-parte.

Sh. Harvinder Aneja, Adv. for the opponent No.2.

Sh. Jasbir Singh Rana, Adv. for the opponent No.3.

                            

               The parties entered into amicable settlement. The counsel for the opponent No.3 offered payment of Rs.53,500/- to the complainant, the amount being equivalent to the invoice Ex.C1 within the period of 45 days, subject to deposit of the product, subject matter of the invoice Ex.C1 with the opponent. The complainant who is present before the Commission in person agreed to the proposal made on behalf of the opponent No.3. Statement of counsel for the opponent No.3 and the complainant recorded.

                     Keeping in view the statement made by the counsel for the opponent No.3 and the complainant, without making any adverse comment on the act and conduct of either of the parties, matter being amicably settled between the parties, the complaint is, partly, accepted against the opponent No.3 only, holding it liable to make payment of Rs.53,500/- (Rupees Fifty Three Thousand Five Hundred only), being equivalent to invoice Ex.C1 to the complainant, within the period of 45 days from the date of order, subject to return of old product, subject matter of the invoice Ex.C1 by the complainant within 15 days from today. The complainant will deposit the old product with the opponent No.2 service centre which will issue receipt in this regard. In case, the opponent No.3 will fail to make the payment of Rs.53,500/- to the complainant within the stipulated period as ordered hereinbefore, then, the opponent No.3 shall be liable to pay simple interest @8% per annum on the amount of Rs.53,500/- from the date of order till actual payment.  Complaint qua opponents No.1 and 2 is dismissed. File be consigned to records.
