ORDER

S.P.Sayal Versus Garg Electric.

CC No. 157 of 2016.

 

Present: Sh. Saurabh Bansal, Advocate, counsel for complainant.

              Sh. Mohit Tayal, Advocate, counsel for OP No.2.

 

                         Power of Attorney on behalf of OpNo.2 filed by Sh. Mohit Tayal, Advocate and made a statement that they are ready to replace the old Air Conditioner of the complainant with new one of same model or alternate with same specification of same price and sought 45 day’s time subject to deposit of old Air Conditioner with all accessories without physical damages.

                        On the other hand, counsel for the complainant made a statement that he has heard and understood the statement of OP No.2 and in view of the aforesaid statement, he withdraws the present complaint.

                        Heard. The proposal made by the counsel for the OP No.2 for replacement of old Air conditioner with new one subject to deposit of old Air Conditioner has been accepted by the counsel for the complainant. Hence, we partly allow the complaint of complainant and OP No.2 is hereby directed to replace the Old Air Conditioner of the complainant with new one within 45 days from the date of order failing which complainant shall be entitled to invoke the jurisdiction of this Forum.  Both the parties are bound by their statement made in the Forum. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
