Heard Sh. Jagdish Gupta – revisionist, who is present in person, on admission and perused the impugned order dated 20.12.2017 passed by the District Forum, Dehradun in execution application No. 51 of 2017.
By way of the impugned order, the District Forum has directed the revisionist – decree holder to file the proposed draft of the sale deed within a period of 16 days’.
Sh. Jagdish Gupta – revisionist has submitted that the impugned order passed by the District Forum be modified and direction be given to the opposite party – judgment debtor to hand over the possession of the shops in question and execute the sale deed in respect thereof in favour of the revisionist – decree holder.
We have passed a detailed order dated 18.07.2017 in Revision Petition No. 07 of 2017; M/s Ganga Builders & Promoters Vs. Sh. Jagdish Gupta, whereby the revision petition filed by the opposite party – M/s Ganga Builders & Promoters, was dismissed. The District Forum has rightly directed the revisionist – decree holder to submit the proposed draft of the sale deed. We find no error in the procedure so adopted by the District Forum.
So far as modification in our earlier order is concerned, in the light of the judgment of the Hon’ble Apex Court given in the case of Rajeev Hitendra Pathak and others Vs. Achyut Kashinath Karekar and another; [2015 (33) LCD 1762], this Commission has no power to recall / review its order.
In view of above, the revision petition being devoid of any merit, is hereby dismissed.
