This complaint has been filed by the complainant u/s 35 of the Consumer Protection Act, 2019 alleging deficiency in service against the opposite parties in selling defective mobile phone along with a prayer to direct the opposite parties to refund a sum of Rs.10,990/- being the cost of the mobile phone, to pay a sum of Rs.2,00,000/- towards compensation for the mental agony and hardship caused to the complainant along with cost.
1st opposite party present. No representation for complainant. Proof affidavit not filed. Several opportunities given on 02.07.2024, 08.07.2024, 19.07.2024 and 22.07.2024. Today also passed over and called twice. However, no representation. Hence, we are of the view that no purpose in keeping complaint on file. Consumer Complaint is dismissed for non prosecution.
