The law helps the diligent, not the indolent. Considering the facts of the case, we would prefer to go by the claim made by the Complainant in the legal notice as well as by prayer (ii) of the complaint and order the OPS to refund to the Complainant the sum of Rs. 2,75,000/- with pending and future interest @ 18% p.a. from the respective dates the 3 instalments were paid, until payment. This would be in accordance with the settled law, indicated hereinabove. No iota of evidence has been placed on record by the Complainant in terms of prayer (iii) of the complaint. The Complainant would be entitled to a sum of Rs. 25,000/- in terms of prayer (iv) and costs of Rs. 5,000/- in terms of prayer (v). The complaint shall stand dismissed in terms of prayers (i), (iii),(vi), (vii) and (viii) of the complaint. The amounts herein awarded to the Complainant shall be paid by the OPs within a period of 30 days failing which the sums awarded in terms of prayer (iv) and (v) shall carry further interest @ 9% p.a. until they are paid.
