Heard the arguments for the counsel for complainant regarding maintainability and pecuniary jurisdiction.  On perusing the complaint, it becomes clear that, the complainant is carrying on the business in Hotels and Resorts, for which he  purchased a 26 HP Diesel Pump set. When this is taken into consideration, the complaint is not maintainability as it is purely for business purpose.

Further the complainant has sought for Rs.50 lakhs for comp3ensatin and Rs.3,27,500/- as cost of the litigation which clearly exceeds the pecuniary jurisdiction of this Forum.  Hence, on the above grounds, this complaint is not maintainable before this forum and hence, this complaint is dismissed.
