J u d g e m e n t.
The present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non transmission of gift of Rs. 85,000/- (Sony Bravia T.V.). The brief facts of the case has summarised here under.
That the complainant is a regular customer of the O.P. and they have previous acquaintance through E- Mail correspondence and when ever any E-Mail transaction is made they used to respond the same. On Dt. 30th. May, 2016 the O.P. has made a call to the complainant and informed him that he is a winner of an item and they were explained that he will get a gift of Rs. 85,000/- (Sony Bravia T.V.) and asked him to remit the shipping and handling charges and also the service tax etc and as per his advise remitted a sum of Rs.15,256/- on 30.5.2016. Prior to that on 27.5.2016 he also asked to remit a sum of Rs.7,725/- for certain items and its shipping charges etc. In total he has remitted a total sum of Rs.22,975/- to the O.Ps account as per his advise for the said products. The O.P. has not sent any such items to the complainant till today and not answering to his correspondence and calls. Finally the complainant could know that it is only an unfair trade practice to extract money without giving any goods or services by them. Due to the above actions the complainant has lost faith on the O.Ps actions and he wanted to take legal action against him for such false information of about the gift etc and asking him to remit money to his account and it is an unfair trade practice to exploit the consumers through E-Mail. Hence this case. The complainant prays the forum direct the O.P. to make shipment of the gifted item worth Rs. 85,000/- (Sony Bravia T.V.) and the money sent to them for the shipment service charges etc. Rs.22,950/- to their account along with compensation Rs.10,000/- and such other relief as the hon’ble forum deems fit and proper for the best interest of justice.
On being noticed the O.P neither appeared nor filed written version. Hence the O.P was set exparte for closing of the case in time.
Heard from the complainant. Perused the complaint petition, documents filed by the complainant.
FINDINGS.
During the exparte hearing the complainant examined himself and proved the payment of the money to the O.P towards shipping and handling charges of (Sony Bravia T.V.) and also the service tax etc. The complainant also argued due to non transmission of (Sony Bravia T.V.) the complainant suffered a lot of financial trouble and mental agony. The complainant submitted that after filing of the case before the forum the O.P. has credited a sum of Rs.7,725/- in the S.B account of the complainant.
In the absence of any denial by way of written version from the side of the O.Ps. it is presumed that the allegations levelled against the O.Ps. deemed to have been proved. The complainant had paid amount for the good service as per O.Ps advise through E-Mail which intended with the O.P and the said payment is made for the consideration for the service. When the O.Ps have failed to give such service as per assurance for which the O.Ps have received the amount. It is deemed that the O.Ps were callous to the allegations and it amounts to deficiency of service.
Hence to meet the ends of justice, the following order is passed.
ORDER.
In the result with these observations, findings the complaint petition is allowed in part on exparte against the O.Ps
The O.Ps are ordered to pay Rs. 15,256/- to the complainant. The O.P is further directed to pay Rs. 5,000/- towards compensation for mental agony and unfair trade practice.
The O.Ps are ordered to comply the above direction within 45 days from the date of receipt of this order. Serve the copies of the order to the parties.
