Jdr is present who has submitted through his Ld. adv and Jdr has shown  that on 07/09/2011 Rs. 10,000/- has been paid to the Dhr and so up to this stage 85% as per BIFR has been paid  and complainant is always  absent. Since 2011 and so the Ex. Case is disposed of with observation that any paid of Jdr's payment is proved false in that case Dhr shall have his full power to reopen the same.
