ORDER

This complaint has been filed by the complainants against the opposite party under section 12 of the Consumer Protection Act, 1986 to handover the possession of the apartment which has been allegedly completed and ready for occupation by the complainant, to carry out the other works including the infrastructure and other amenities within a stipulated time, to comply with the statutory requirements including Registration of the Project and other compliances as per the Real Estate (Regulation and Development) Act, 2016, to pay the statutory interest of 10% on the amount already paid (i.e. Rs.70,62,732/-) for the delay in delivery of the apartment from 01.04.2016 till the date of delivery of the apartment, to reimburse the payments amounting to Rs.7,54,608/- (Rs.2,07,250/- + Rs.4,55,000/- + Rs.92,358/-) which were received by the opposite party towards the services / facilities which were promised but not provided by the opposite party and to pay a sum of Rs.5,00,000/- towards compensation for damages, pain, tension, inconvenience, frustration and mental agony and cost of proceedings to the complainant.

The complainant and Counsel made an endorsement.    In view of the endorsement, this complaint is dismissed as withdrawn with liberty to file a fresh case before the appropriate Forum.    No costs.
