At the time of arguments, it transpired that the total price of the unit, in question, as per Final Statement of Account annexed with the offer of possession letter dated 29.06.2017 (Annexure C-3), is in the sum of Rs.95,83,977.13 (i.e. Rs.95,25,142.93 + Rs.58,834.20).  The complainant has prayed for reasonable rate of interest on the deposited amount from 28.10.2016 till handing over of actual physical possession of the unit, in question, complete in all respects; compensation @Rs.9,290/- per month from 28.10.2016 till handing over of possession and Rs.1 Lac as compensation. By adding the component of interest even at the prevailing Bank rate on Fixed Deposits and other reliefs i.e. compensation etc., in view of ratio of judgments passed by Hon'ble National Consumer Disputes Redressal Commission, New Delhi in the cases of AMBRISH KUMAR SHUKLA & 21 ORS. Vs. FERROUS INFRASTRUCTURE PVT. LTD., Consumer Case No.97 of 2016, decided on 07.10.2016 & M/s OMAXE CHANDIGARH EXTENSION DEVELOPERS PRIVATE LIMITED & ORS. Vs. LALITHA SAINI, First Appeal No.1364 of 2017, decided on 21.08.2017, it exceeds the pecuniary jurisdiction of this Commission. Faced with this situation, Counsel for the complainant wishes to withdraw this complaint with liberty to file it before Hon'ble National Consumer Disputes Redressal Commission, New Delhi.

                   Liberty granted.

                   Accordingly, this complaint is dismissed as withdrawn.

                   Certified copies of the order be sent to the parties free of charge.
