Heard Sri Sankalp Mehrotra, learned Counsel for the appellant.
This appeal has been filed under Section 41 of the Consumer Protection Act, 2019 against the order dated 10-09-2021 passed in Complaint Case No. 433/2013 by the District Consumer Commission, Gautam Budh Nagar, by which order the appeal filed by the complainant/appellant Dr. Harnam Singh Madan has been dismissed on the ground of non-prosecution by the complainant. The following order has been passed by the learned District Consumer Commission on 10-09-2021.
''पत्रावली पेश हुई। पुकार कराई गई। परिवादी अनुपस्थित है विपक्षी

संख्या-2 उपस्थित है। पत्रावली के अवलोकन से विदित है कि परिवादी अनेक तिथियों से उपस्थित नहीं आ रहा है। परिवादी का परिवाद परिवादी की अनुपस्थित में खारिज किया जाता है। पत्रावली दाखिल दफ्तर हो।''
When the instant appeal came up for consideration on 13-01-2022, this Court has directed the learned Counsel for the appellant to file the details of the orders passed by the learned District Consumer Commission in between year 2018 to 2021 by passing the following order:-

वाद पुकारा गया। अपीलार्थी के विद्वान अधिवक्ता श्री संकल्प मेहरोत्रा उपस्थित है। प्रस्तुत अपील को पुन: दिनांक 19.01.2022 को नवीन वाद सूची में सुनवाई हेतु सूचीबद्ध किया जावे। इस मध्य अपीलार्थी के विद्वान अधिवक्ता कार्यालय में परिवाद सं0-433/2013 से सम्बन्धित वर्ष-2018 से 2021 तक के आदेश फ़लक की प्रतियॉ विविध प्रार्थना पत्र के साथ प्रस्तुत करेंगे।“
In compliance of the aforesaid order dated 13-01-2022, learned Counsel for the appellant has filed an application for taking documents on record. The said application dated 13-01-2022 has been signed by the learned Counsel for the appellant Sri Sankalp Mehtora and in para 2 of the said application the details of the dates of the orders passed by the learned District Consumer Commission, Gautam Budh Nagar are mentioned as orders dated 22-06-2018, 27-08-2018, 25-10-2018, 26-12-2018, 27-02-2019, 09-05-2019, 10-07-2019, 29-08-2019, 25-10-2019, 16-12-2019, 14-02-2020, 25-06-2020, 19-09-2020, 02-01-2021, 28-01-2021, 19-02-2021, 06-05-2021 and 10-09-2021.
From the perusal of the aforesaid orders passed by the learned District Consumer Commission, Gautam Budh Nagar, between 22-06-2018 to 10-09-2021 we find that the hearing of the aforesaid complaint was either adjourned on account of non-availability of the quorum of the District Consumer Commission or due to strike call given by the learned Counsels/Bar Association of the District Consumer Commission, Gautam Budh Nagar. It is also noticed that on two dates Counsel for the complainant

was absent whereas on many dates the opposite parties were unrepresented.
In view of the aforesaid, without going into the merits of the case, we deem it appropriate to direct the learned District Consumer Commission, Gautam Budh Nagar to hear the Complaint Case No. 433/2013 and decide the same on merits.
In view of above, the appeal is allowed. The impugned order dated 10-09-2021 passed by the District Consumer Commission, Gautam Budh Nagar in Complaint Case No. 433/2013 Dr. Harnam Singh Madan V/s M/s Deluxe Packers & Movers and another is set aside. The matter is remanded back to the District Consumer Commission, Gautam Budh Nagar and it is hereby directed that the learned District Consumer Commission will decide the complaint expeditiously, without granting unnecessary adjournments to either of the parties, preferably within a period of four months.
Let copy of this order be made available to the parties as per rules.
