ORDER:
In this case, the complaint was filed by the complainant with the prayer to pay the amount of Ras.4,35,000/- with interest @ 10.25% per annum from the date of illegal charge of interest till realization.
Today the case was fixed for consideration on the statement of Shri Ajay Yadav, counsel for the complainant.
On 26.04.2024 Shri Ajay Yadav, counsel for the complainant has suffered a statement that “I press only for harassment, litigation charges and interest.”
On the basis of the statement of Shri Ajay Yadav, counsel for the complainant, the Commission is of the opinion that after filing of the complaint, opposite party has refunded and paid to the complainant having beneficiary bank A/c. No. 057104000011820 vide NEFT No CMS230477201629 on 16.02.2023 for an amount of Rs.4,37,164/-. Opposite party has harassed the complainant mentally. Hence, opposite party is negligent on their part. Deficiency of service is proved. . Hence the complaint is disposed off with the direction to opposite party to pay Rs.5500/- as compensation on account of mental tension, agony and harassment. Opposite party is also directed to pay Rs.2200/-as litigation expenses to the complainant. Compliance of this order be made within 30 days from the date of receipt of copy of order. Copy of this order be given to the parties concerned free of costs and file be consigned to record room.
