Appeal under Section 15 of the Consumer Protection Act, 1986 against order dated 08.03.2017 passed by  District   Consumer Disputes Redressal Forum-II, U.T. Chandigarh in Consumer Complaint No. 374/2015.

               Appellant/Complainant has filed this appeal against order dated 8.3.2017 passed by the District Consumer Disputes Redressal Forum-II, U.T., Chandigarh (in short the Forum only), vide which his complaint was dismissed. 

 2.         The dispute was raised qua 4 Insurance Policies, detail of those policies reads thus ;

It was case of the complainant that the Policies were sold to him under misrepresentation and he had sought refund of the amounts paid.

3.           The Forum noticed  that all the policies were issued in the year 2010 and 2011. The complaint was filed in the year 2015, and as such, it was barred by limitation.  Taking note of the provision of Section 24-A of the Consumer Protection Act, complaint was dismissed.

4.          The view taken by the Forum is perfectly justified. There is nothing on record to show that why the complainant/his relations failed to act and react when the policies were issued in the year 2010 and 2011 respectively.  No inter-se correspondence between the parties qua wrong issuance of policies and seeking refund within two years of issuance of the policies has been placed on file.    In view of the above, no case is made to interfere in the order, under challenge.

5.         For the reasons recorded above, the appeal, being devoid of merit, must fail, and the same is dismissed, with no order as to costs. The order of the District Forum is upheld.

6.           Certified copies of this order, be sent to the parties, free of charge.

7.     The file be consigned to Record Room, after completion.
