Consumer Complaint No. 65 Of 2015

                                                                        O R D E R

27.06.2016  Case is posted to-day for hearing. After going through the complaint petition, written version, materials available on record and only after hearing from both the sides, it came to our notice that the complainant and the OPs both are business establishments and running their business all over Odisha. The OPs engaged the complainant as an authorized service centre to provide proper service to the customers of the OPs who did not pay bills of Rs.1,20,935/- towards servicing and repairing charges to the complainant. From the contents of the complaint petition the complainant claims to have hired the services of the OP and claims the amount of bill  from the OPs.

                                    The present case is nothing but a case i.e. dispute between two businessmen. In no way the complainant can be achieved to the status of a consumer. As the dispute is a business to  business dispute. Further no consideration was being paid by the complainant to the OPs and availed services of the OPs. But in this case the matter is reverse. Rather the complainant has rendered was ignored by the OPs. It is a completely Civil Dispute and not a Consumer Dispute.

                                    We, therefore, dismissed the complaint as the same is not maintainable before  this Forum with liberty to the complainant  to seek for his redressal in Civil Court.

                                    The case is disposed of . Copy of this order shall be supplied to the parties as per rule.
