                                    Smt. Jigeesha Mishra, President:-

13.09.2022:               Advocate for both the parties are present before this  Commission. Perused the petition U/s-72(1) of C.P.Act,2019 as filed by the complainant so also perused the perused the petition filed by O.P on earlier.  Heard from both the parties.   The O.P files objection petition U/s-72(1) of C.P.Act,2019 along with  documents as loan taken by the complainant from the O.P i.e. Cholamandalam Finance.  It is evident from the documents that the complainant has three vehicles bearing regn. No. OD-23-G-8968 vide contract No. XVFPJRA00002589490,vehicle bearing regn. No. OD-23-J-7309 vide contract No. XVFPJRA0003227688 and vehicle bearing regn. No. OD-23-C-5393 vide contract No. XVFPJRA00002188719 which was financed by the O.P.  The advocate for the complainant has also admitted that the complainant has three number of vehicles.  The complainant has suppressed the material facts to the Commission.  All three number of vehicles are used for commercial purposes for which the complainant is not a consumer of the Opposite party.

                                    In view of facts and circumstances the complaint of the complainant is not maintainable. Hence the present complaint is dismissed.

                                    The complainant has submitted a cheque of Rs.3,00,000/-              ( Rupees three lakh) only vide cheque No. 000021 dt.09.08.2022 issued by Uco Bank, Belpahar Branch in the commission on dtd.10.08.2022. The complainant is at liberty to receive the cheque.

Order pronounced in the open court today the 13^th day of Sept’2022 under my hand seal of this Commission.
