NAWAB SINGH J, (ORAL)

 

          Complaint titled M/s Chawla Stone Crusher, Khanak, District Bhiwani Versus Dakshin Haryana Bijli Vitran Nigam Limited and others was decided by District Consumer Disputes Redressal Forum, Bhiwani (for short ‘District Forum’) vide order dated April 18th, 2007.

2.      Aggrieved of the said order, Dakshin Haryana Bijli Vitran Nigam Limited and its functionaries-opposite parties (for short ‘Nigam’) filed Appeal No.2572 of 2007 before this Commission. The said appeal was transferred from this Commission to State Consumer Disputes Redressal Commission, Union Territory Chandigarh. The State Commission, U.T. Chandigarh dismissed the appeal vide order dated December 21st, 2008. At the time of filing of the appeal, the Nigam had deposited the statutory amount of Rs.25,000/- before this Commission as reported by the office.

3.      The Nigam filed Miscellaneous Application No.358 of 2016 before the State Commission, U.T. Chandigarh. The said application was disposed of by the State Commission, U.T. Chandigarh on October 20th, 2016 giving liberty to Nigam to file the application for refund of the amount before this Commission.

4.      Shri B.D. Bhatia, Advocate has placed on record the photocopy of the order dated November 05th, 2007 (Annexure-B) passed by District Forum, Bhiwani, whereby the execution application filed by the complainant was disposed of having being fully satisfied.

5.      Since, the statutory amount of Rs.25,000/- is lying before this Commission, so, it is hereby ordered that the said statutory amount be released to the Nigam against proper receipt and identification in accordance with rules

6.      Disposed of accordingly.
