A.T.Munnoli,<br /> President<br /> <br /> 1. Though the complainants are different, opposite parties are common in all the cases. The facts alleged by the respective complainants in the complaints, is same or similar, except the amount and the dates. The defense of the opposite parties is also common. Hence, for the convenience, all the cases are being disposed off by the common order.<br /> <br /> 2. By the order dated 16.06.2010 in CC No.237/2010, the remaining 249 cases are clubbed. All the relevant proceedings are noted only in the order sheet of the main case.<br /> <br /> 3. The complainants have filed the complaints under Section 12 of the Consumer Protection Act 1986, alleging deficiency in finance service on the part of the opposite parties that, the fixed deposit amount with interest has not been paid, in spite of the demands made.<br /> <br /> 4. The facts alleged in the complaints in substance are that, the first opposite party is a registered partnership firm. Opposite parties 2 to 10 were and are it’s partners. The firm is carrying on the business of financial activities of lending and borrowing money besides accepting deposits, assuring the depositors prompt refund of the deposited amount, whether before or after the date of maturity and interest thereon at the regular intervals. The complainants have kept the amount in fixed deposit with the firm as per the terms and conditions and the Rules and Regulations of the scheme framed. The particulars of the fixed deposit, Serial number of the case, receipt No., date of receipt, the date of amount deposited, the date of maturity, period of deposit, rate of interest and the interest paid upto the date, are all shown in Annexure-A of the order. For brevity and convenience, to avoid repititon, we do not wish to mention the same here. The complainants requested the opposite parties to refund the deposited amount with interest, but there is no response. Even, notices were issued, but, the amount has not been refunded on the ground that, the firm and the partners have no sufficient liquidity and the opposite parties are postponing the payment on one or the other pretexts. Accordingly, it is prayed to direct the opposite parties to refund the fixed deposit amount with interest thereon and the compensation as well as cost of the proceedings.<br /> <br /> 5. The first opposite party is the firm represented by it’s managing partners, the second and third opposite parties. In spite of due service of notices, opposite parties 1 to 3 have remained exparte.<br /> <br /> 6. Opposite parties 4 and 6 to 10 have filed common version in CC No.237/2010 and by filing a memo, adopted the same in all other clubbed cases. By filing a memo, fifth opposite party has also adopted the said version.<br /> <br /> 7. In the version, it is contended that, the complaints are not maintainable either in law or on facts. The complainants are not consumes. It is stated that, these opposite parties themselves are victimized and the resources of the first opposite party have been siphoned out. The second and third opposite parties have acted outside the scope of deed of partnership. Said acts are not binding on these partners. The managing partners have not rendered account to these partners. Said managing partners have lent without security and consent of other partners. The complainants can recover the amount personally from second and third opposite parties through civil claim. These opposite parties have already entrusted the matter in issue under the civil law before the competent Civil Court. The second and third opposite parties are accountable not only to the depositors, but also these opposite parties. Hence, it is prayed to dismiss the complaints.<br /> <br /> 8. In all the cases, except CC Nos.362, 381, 483, 484, 485 and 486/2010, the complainants have filed their affidavits in support of their claim made in their respective complaints. In all the cases, the respective complainants have produced copy of the fixed deposit receipt and certain other documents. On the other hand, tenth opposite party has filed his affidavit in CC No.237/2010. A memo is filed, adopting the same in all the clubbed cases. For O.P.4 to 9 memos are filed, adopting the evidence of tenth opposite party in all the clubbed cases. Learned advocate for the complainants has filed written arguments. We have heard the arguments of the learned advocates for the complainants and the opposite parties and perused the records.<br /> <br /> 9. Now the points arises for consideration are as under:-<br /> 1. Whether the complainants have proved that, they are the consumers and that, the complaints are maintainable?<br /> 2. Whether the complainants have proved that, they have kept the amount in fixed deposit with the opposite party firm?<br /> 3. Whether the complainants have proved that, they are entitled for refund of the fixed deposit amount with interest?<br /> 4. Whether the complainants have proved (in some of the cases), pre-mature withdrawal is permissible?<br /> 5. Whether opposite parties 4 to 10 have proved that, they are not liable for the claim of the complainants?<br /> 6. Whether, fifth opposite party has proved that, she is not liable for the claim of the complainants in respect of the deposits with the firm prior to it’s re-constitution?<br /> 7. What order?<br /> <br /> <br /> 10. Our findings are as under:-<br /> Points no.1 to 4 : Affirmative.<br /> Points no.5 to 6 : Negative.<br /> Point No. 7 : As per final order.<br /> <br /> REASONS<br /> <br /> 11. Point no. 1:- From the evidence on record, it is fact that, the first opposite party is a registered partnership firm carrying on the business of financial activities of lending and borrowing money besides receiving deposits agreeing to pay interest thereon. The complainants claim that, they have kept the amount in fixed deposit with the first opposite party firm on certain terms and conditions. The opposite parties on record have contended that, the complainants are not consumers and the complaints are not maintainable.<br /> <br /> 12. Learned advocate for the opposite parties vehemently argued that, the complainants are not consumers as no service is rendered by the opposite parties and no amount is collected by the opposite parties regarding rendering service and that, opposite parties are doing money lending business and the payment of interest does not amounts to service. Also, he submitted that, the F.D. receipts are like pronote and that, the complainants have sought recovery of the amount and hence, the complaints are not maintainable.<br /> <br /> 13. The relevant portion of definition of ‘consumer’ provided under section 2 (1)(d)(ii) reads thus,<br /> (ii) (hires or avails of) any services for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment and includes any beneficiary of such services other than the person who (hires or avails of) the services for consideration paid or promised, or partly paid and partly promised, or under any system of deferred payments, when such services are availed of with the approval of the first mentioned person (but does not include a person who avails of such services for any commercial purpose);<br /> <br /> 14. Copy of deed of partnership of the first opposite party firm is on record. Nature of business of the firm stated therein is dealing in banking or other business. During the course of arguments also, the learned advocate for the opposite parties admitted that, the opposite party firm is doing finance business. As noted in the deed of partnership, first opposite party firm is doing banking business. In the definition of service noted above, banking as well as finance amounts to service.<br /> <br /> 15. The service is defined in section 2(1) (o) as under:<br /> “Service” means service of any description which is made available to potential (users and includes, but not limited to, the provision of) facilities in connection with banking, financing, insurance, transport, processing, supply of electrical or other energy, board or lodging or both, (housing construction), entertainment, amusement or the purveying of news or other information, but does not include the rendering of any service free of charge or under a contract of personal service.”<br /> <br /> 16. Advocate for the complainant referred to the copy of the printout taken from internet regarding the meaning of the banking, which reads as under:<br /> “In the broadcast sense of the term, “banking” is the business of accepting temporary responsibility for safeguarding other people’s money (“deposits”) and then lending out these funds (along with the bankers’ own funds) in order to earn interest for the bank’s own account. Banking firms thus earn their profits primarily by serving as “financial intermediaries” who mobilize the scattered savings of many households and firms (by offering safe keeping services and paying interest on at least some kinds of accounts) and then make these pooled funds available to suitable borrowers (to business firms that want to finance proposed investment projects or perhaps to consumers who want to finance big ticket durable consumers’ goods like automobiles or perhaps to governmental entities whose policy-makers have deiced to spend more money than they have received in revenue collections). The bank pledges its own capital (and also buys outside deposit insurance) to guarantee that any depositor can get all his/her money back in cash no later than some contractually specified length of time after giving notice of withdrawal. The bank makes this somewhat risky guarantee even though it is quite predictable that some (hopefully small) percentage of the loans the bankers make using depositors’ funds will “turn sour” and not be repaid by the borrower. The bank’s profits arise mainly from the (positive) spread between its costs of securing and servicing deposits and its revenues from fees and interest on the loans extended. (Of course banks frequently seek to make additional profits selling other financial services to their clients and customers as well, but the business of accepting deposits and making loans is the defining core of the banking business).”<br /> <br /> 17. Learned advocate for the complainants has placed on record, the Rules and Regulations governing the deposit of the opposite party firm printed on the overleaf of the fixed deposit application form, wherein various terms and conditions regarding the financial service are mentioned.<br /> <br /> 18. Hence, service of banking or financing amounts to “service” as defined under the Act. Likewise, the complainants have availed the said service of the opposite parties and as such, they are “consumers”.<br /> <br /> 19. Further, for the complainant, learned advocate relied on the ruling reported in I (1994) CPJ 377 wherein Hon’ble Orissa State Commission has held that, non-payment of matured fixed amount is a deficiency in service. The Hon’ble National Commission in III (2002) CPJ 243 has held that, under a scheme deposits were accepted, but refund was denied, amounts to deficiency in service. Hon’ble Andhra Pradesh State Commission also in I (1999) CPJ 2 has taken the same view. In the ruling reported in III (2006) CPJ 390 also Hon’ble National Commission has held that, promise made by the finance company to pay interest on the deposit, is a service for a consideration. In another ruling reported in II (2006) CPJ 380 at paragraph 8, Hon’ble National Commission has held that, consumer-depositor has right to file complaint against a non-banking finance company under the Consumer Protection Act. Recently, Hon’ble Chatisghad State Commission in the ruling reported in 2010 (2) CPR 388 has held that, non-banking financial institution had collected deposits and issued receipts to the depositors and failure to pay the fixed deposit amount to the depositors on maturity, amounts to deficiency in service.<br /> <br /> 20. Considering the provisions of the Consumer Protection Act, as well as the law laid down in various rulings cited supra, we are of the considered opinion that, the complainants are consumers and that, the complaints are maintainable. Accordingly, finding on the point is in affirmative.<br /> <br /> 21. Point No.2:- So far concerned to the fact that, the complainants have kept the amount in F.D. with the first opposite party firm, there is no serious dispute. In all the complaints, the respective complainants have alleged that, they have deposited the amount and that fact is stated in the affidavits. That statement is supported by the documents issued by the opposite party firm. We do consider that, in CC Nos.362, 381, 483, 484, 485 and 486 of 2010, the complainants have not filed their affidavits. But, the F.D. receipts issued by the opposite party firm are on record. Said receipts are not denied or disputed by the opposite parties. Hence, considering the facts and the evidence on record, the respective complainants have proved that, they have kept the amount in F.D. with the opposite party firm. The opposite parties have contended that, the matter in issue under the Civil law is entrusted before the Competent Civil Court. But, it is well-settled that, the remedy provided under the C.P.Act is additional or alternative remedy and the recourse to other remedy is no bar as held by the Hon’ble National Commission in the ruling cited supra. Accordingly, finding on the point is in affirmative.<br /> <br /> 22. Point No.3:- In view of the findings on point numbers 1 and 2 in affirmative, the complainants are entitled for refund of the amount that they have kept with the opposite party firm. As regards interest, the opposite parties are liable to pay the interest as agreed, which is mentioned in the respective receipts. However, the complainants have also claimed interest at the rate of 18% p.a. from the date of default made by the opposite party firm in paying the interest. Since, there is contract or agreement between the parties regarding payment of interest, the complainants are not entitled for the interest at the rate of 18% p.a. With this observation, our finding on the point is in affirmative.<br /> <br /> 23. Point No.4:- Learned advocate for the opposite parties strenuously argued that, in many cases the deposits are not matured and hence, complaints are not maintainable and the complainants are not entitled for any reliefs. We do consider that, as shown in the Annexure-A of the order, in many cases the amount is not matured. But, it is relevant to note the Rules and Regulations governing deposits of the first opposite party firm, copy of which is placed on record by the complainants. 9th Rule or Regulation provides that, deposits cannot be withdrawn before the maturity date except special circumstances and if allowed, it will 2% less than the rate permissible for the period during which the deposit was held. Thus, pre-mature withdrawal is permissible. As regards the circumstances, it is made out by the complainants that, the interest was agreed to be paid monthly or quarterly, but from the dates mentioned in the complaints, the opposite party firm stopped payment of the interest. Also, it is submitted that, the complainants invested their hard earned money and in many cases, the interest is the source of livelihood for many of the complainants. Taking into consideration of all these aspects, premature withdrawal sought by the respective complainants is permissible. Also, it is relevant to note that, Hon’ble National Commission in a ruling reported in 2006 CPJ II 318 in paragraph 13 has held that, pre-mature withdrawal of the F.D. is permissible. Also, it may be taken into consideration that, even the nationalized or other banks also permit pre-mature withdrawal of the F.D. However, in such cases reduced rate of interest will be paid. Similarly, in the case on hand, according to the Rule noted above of the first opposite party firm, in case of pre-mature withdrawal, 2% interest is to be reduced. Accordingly, our finding on the point is in affirmative.<br /> <br /> 24. Point No.5:- The opposite parties on record have contended that, first and second opposite parties Managing partners have siphoned out the resources of the firm and hence, they are not liable for the claim of the complainants. In this regard, at the outset, for the complainants with reference to various provisions of the Indian Partnership Act, it is submitted that, the liability of the respective partners will be as per the deed of partnership. In the case on hand, copy of deed of partnership is on record. It is specifically provided in paragraph 12 of the deed that, share of profit or loss shall be equal among all the partners. Hence, contention of the opposite parties 4 to 10 that they are not liable for the claim of the complainants, cannot be accepted. On the other hand, in 7th paragraph of the version, it is stated that, the second and third opposite parties are accountable to not only the depositors, but also to these opposite parties. Thus, even as stated in the version, claim of the complainants cannot be disputed. They are entitled for the claim even as admitted in the version noted above. Accordingly, our finding on the point is in negative.<br /> <br /> 25. Point No.6:- From the records, it appears that, the 5th opposite party intend to contend that, she is not liable to the claim of the complainants in respect of the deposits made prior to re-constitution of the firm. Firstly, no such specific contention is taken in the version and secondly, in view of the terms and conditions of the deed of partnership, all the partners are equally liable for loss and profit. Hence, the finding is in negative.<br /> <br /> 26. Point No. 7:- Considering the discussion made above and conclusion arrived at, we pass the following order:- <br /> <br /> ORDER<br /> <br /> 1. The Complaints are partly allowed.<br /> 2. The first opposite party firm represented by it’s partners opposite parties 2 to 10, jointly and severally shall pay the amount shown in Col.No.5 of the Annexure-A of the order to the respective complainants with interest at the rate shown in Col.No.8 from the date shown in Col.No.9, within a month from the date of the order, in cases of matured F.D. receipts, the dates shown in Col.No.6, and in respect of pre-mature cases, 2% interest less than the rate shown in Col.No.8. <br /> 3. Further, opposite parties shall pay cost of Rs.2,000/- to each of the complainants.<br /> 4. The original order shall be kept in CC 237/2010 and the copy in CC 238 to 486/2010 cases.<br /> 5.
