                                                JUDGEMENT.

The  crux of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for  non payment of  deposited amount   for which  the complainant  sought for redressal of the grievances raised by the complainant.                                       

On being noticed the O.Ps appeared through their  learned counsel   and filed written version and prays the Commission  to dismiss the case against the O.Ps for the best interest of justice.

Heard from the  complainant inter alia from the learned counsel for the  O.Ps at  length.  We perused the complaint petition and the documents filed by both the parties.  

                                          FINDINGS.

            In  the written version  the O.Ps  have submitted that  on getting the show cause notice from the  Commission  this office has taken  prompt action to close  present case and  paid Rs.45,000.00 (Rupees   forty five thousand)only  to the complainant  towards full  and final settlement   and settled the  matter  out of court between the  parties.

During the course of   hearing  the complainant is present  in person before the  Commission  and filed  a memo  submitted that  the O.Ps  had credited  Rs.45,000/- in the  S.B. account of the  complainant   and settled the matter out of court. Hence  the  complainant  prays the commission  kindly be closed  case   as  he  does not want to proceed the case further.

                Verified the Memo and  relevant documents  filed  by both  the parties. The complainant had filed  the memo with his full and final settlement of their claims with out any  protest. The complainant prayed  to with draw the case.

                Considering the exigencies of the case  accordingly the present C.C. case is hereby closed & O.Ps are  wriggled out of the liability  of the case .

            Copy  of the order be supplied  free of cost to the parties.
