O R D E R

  1.    This is an appeal filed U/s.15 of CPA 1986 by Complainant aggrieved by the order dtd.14.09.2018 passed in CC/296/2018 on the file of 4th Addl., District Forum, Bengaluru urban. (Parties to the appeal henceforth are referred to their rank assigned to them by the District Commission).

 

  1. The Commission examined grounds of appeal, impugned order, appeal papers and heard.

 

  1. The District Forum held “before knocking the door of the Forum, issuance of notice in respect of the claim is mandatory. If the claim is settled on issuance of notice, there should not be any further proceeding as an amount of Rs.99/- is already paid by the OP which is treated as the matter settled at the pre-litigation stages. When such being the fact, the complaint filed by the Complainant is not maintainable for seeking the ancillary relief that is to get compensation” which in our view does not call for any interference for the grounds set out in the appeal memo. Hence proceed to dismiss the appeal with no order as to cost. 

 

  1. Notify copy of this Order to the District Commission and parties.
