AWARD

1.   Vide his separate statement recorded on 10.10.2023, Sh.Prabhat Bhalla, Complainant stated that the matter has been amicably settled between the parties and as per amicable settlement, he has agreed to transfer the subject plot No.58-A, situated at VIP Enclave, Derrabassi (Punjab) in favour of OP No.1 & 2 or any duly authorized person by OP No.1 & 2 or any subsequent purchaser on payment of Rs.20,50,000/-, out of which he has received demand draft amounting to Rs.20,00,000/- bearing draft No.500004 dated 04.10.2023 drawn on ICICI Bank in his favour, from OP No.1 & 2 through their counsel Sh.Balwinder Singh Jolly, Advocate and the remaining amount of Rs.50,000/- will be paid by OP No.1 & 2 at the time of execution of the sale deed qua the subject plot in favour of OP No.1 & 2 or any duly authorized person by OP No.1 & 2 or any subsequent purchaser. It has been further stated by the complainant that the NOC from the bank regarding loan clearance will be provided by him to the OP No.1 & 2 within 30 days from 10.10.2023. It has been further stated by the complainant that the OP No.1 & 2 shall inform him, through e-mail/whatsapp, one week prior before the date fixed for the execution of the sale deed and he will also surrender all the original documents pertaining to the subject plot to the OP No.1 & 2 before the execution of the sale deed. It has been further stated by the complainant that on the execution of the sale deed, he shall be left with no right, title or interest in the subject plot and both the parties shall be bound by amicable settlement. The complainant has prayed that present consumer complaint be disposed of in terms of the settlement in Upbhokta Lok Adalat and he has withdrawn his complaint against OP No.3 & 4. Vide his separate statement recorded on 10.10.2023, Sh.Balwinder Singh Jolly, Counsel for OP No.1 & 2 has admitted the aforesaid statement of the complainant.

2.   In view of the statements made by the complainant as well as counsel for OP No.1 & 2, the present consumer complaint is disposed of being settled. The complainant and OP No.1 & 2 shall be bound by the statements made on 10.10.2023, as stated above. However, the present consumer complaint stands dismissed as withdrawn against OP No.3 & 4.

3.   The award is accordingly passed.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
