Shri B. Mukhopadhyay, President. This is an application u/s.12 of the C.P. Act, 1986. Ld. Lawyer of the complainant is absent but Ld. Lawyer for the OP has submitted that the necessary order may be passed after considering the written version in view of the fact that OPs are willing to give connection after compliance of the entire matter as per law. Considering the prayer of the complainant and it is found that complainant as one of the flat owners has prayed for directing the OP to give new connection from the existing service of 113/1, M.M. Feeder Road, Kolkata – 700 057. From the report of the OP it is clear that the complainant was advised to identify in consulting with other flat owners a suitable common position for shifting of existing A/c. Service of the above premises and complainant was asked to inform the selected place for re-inspection of the premises before proceeding further. Further it is found that OP is willing to arrange for giving connection if complainant is able to give free access for installing new meter in the scheduled premises including payment of outstanding dues if any, security deposit, service charges etc. it is also fact that it is a multi-storeyed building consisting of 26-27 flats and OP needs proper steps to accommodate a longer seized meter board so as to cover the supply of all the flat owners or occupants but present board cannot accommodate all such meters. Otherwise it may endanger human right or loss of property. Considering the entire situation and also taken into consideration of the present multi-storeyed building we find that OP has rightly pointed out the very vital factor of steps and, in fact, the present multi-storeyed building is consisting of 26-27 flats. So, complainant along with other flat owners (Flat Owners’ Association) must have to give a proper space for free access to install a big board to cover the present situation and accordingly this complaint is disposed of finally with a direction to the OP to take proper steps at once and at the same time complainant shall have to point out a safe place of the said multi-storeyed building for getting electric connection because the present area is unsafe damaged and for which complainant shall have to inform the OP at once what space shall be allotted to the OP for giving a bigger board for giving connection to all the flat owners. In this context it is to be mentioned that as per provision of Electricity Act at the time of constructing any multi-storeyed building a safe room or space must be given to the OP Electricity Authority for installations of meters for all the flat owners but if it is not kept in that case it is the fault of the flat owners. Anyhow, we are directing the complainant to keep contact with the OP and informed OP what space has been fixed by flat owners including the complainant for fixing meter boards for all the flat owners and in that case OP shall have to inspect and check and take all such steps so that the matter may be settled in between the complainant and all the flat owners and the OP for the proper protection of the said multi-storeyed building before giving any connection in the said multi-storeyed building to give electric connection to the complainant. Parties are directed to comply this order and no further order is passed in this regard.
