Per Justice Shri S.B.Mhase, Hon’ble President:

          Heard Adv.Mr.A.Patwardhan for applicant/decree holder.

          Ld.Counsel states that certificate under Section 25(3) has been issued and Collector has not been proceeded under said Section because only immoveable property is available for execution.  He also states that Apex Court has given certain directions in this respect.  He has to follow those directions.  He also submits that proper application will be made pointing that other remedies are available so as to execute the order of Consumer Fora as per certificate issued.  So, on instructions of decree holder/applicant, who is present before State Commission, he submits that he may be allowed to withdraw the execution application.  Allowed to withdraw.  Hence, we pass the following order:-

1.                 Execution application nos. 2011/1 stands disposed of as withdrawn.

2.                 No order as to costs.

3.                 Dictated on dais.

4.                 Copies of the order herein be furnished to the parties as per rule.
