Present:      

For the applicant/ DH:   Sh.Dev Raj, applicant/ decree holder in person.

For JD No.1 & 2:           Sh.Amandeep Singh, authorized representative of the JD.

For JD No.3                   Sh.Satvir Singh, Advocate.      

          Sh.Dev Raj, applicant/ decree holder has filed an application for releasing him the amount which was sent by Hon’ble State Consumer Disputes Redressal Commission, Punjab, Chandigarh. Sh.Satvir Singh, Advocate filed memo of appearance on behalf of JD No.3.

 Sh.Amandeep Singh authorized representative of JD No.1 and 2  i.e. Brar Auto Wheel Private Limited, Ludhiana Road, Moga  has filed authority letter given by JDs No.1 and 2 i.e. Brar Auto Wheel Private Limited, Ludhiana Road, Moga as well as his identify proof i.e. Aadhar Card and also  made statement   before this Forum separately that they have no objection if the amount of Rs.27,009/- is made to the Decree holder. The relevant statement of Sh.Amandeep Singh, authorized representative of the JD  i.e. Brar Auto Wheel Private Limited, Ludhiana Road, Moga is reproduced as under:-

“Stated that the above noted appeal filed by Brar Auto Wheel Private Limited, Ludhiana Road, Moga has been dismissed by Hon’ble State Consumer Disputes Redressal Commission, Punjab, Chandigarh vide order dated 04.06.2018. At the time of filing the appeal, we have deposited a sum of Rs.25,000/- before Hon’ble State Commission, Punjab, Chandigarh. Now the said amount alongwith its accrued interest amounting to Rs.27,009/- has been sent before this Hon’ble Forum, by Hon’ble State Commission.

It is again stated that we have not filed any further  appeal before any higher competent authority either Hon’ble National Commission or we have any intention to file any such appeal against the order passed by Hon’ble State Consumer Disputes Redressal Commission, Punjab, Chandigarh. We have no objection, if the said amount of Rs.27,009/- is made to the decree holder i.e.Dev Raj.”

 In view of the aforesaid statement of Sh.Amandeep Singh, authorized representative of JDs No.1 & 2  i.e. Brar Auto Wheel Private Limited, Ludhiana Road, Moga,  the office is directed to release the requisite amount of Rs.27,009/- to the applicant/ decree holder on proper receipt and identification. Thereafter, this Misc.Application be attached with main complaint case and the file be consigned to record room after compliance.
