ORDER

            The petition was filed on 21-01-2013. The case of the complainant is that he had taken an Air Tel HD digital DTH TV connection ( Consumer ID 3011123017 ) on 11-10-2012 from Dotnet Solutions who is a retailer of the opposite party. The complainant took up Airtel digital HD connection as the opposite party had given an offer of 15 HD channels in which ESPN HD & Star Cricket HD were a part of that offer. As per the request of the opposite party the complainant had paid a 6 months payment in advance. On December 20^th the complainant received an SMS from the opposite party saying that ESPN & Star Cricket is not available anymore and refunded Rs.100/- to his account. The complainant is not aware why and for what reason Rs.100/- was deposited in his account. On December 24^th on wards opposite party removed two H.D. channels. The surprise thing is opposite party added two new channels. But he had no access to the same. These are not added in complainant’s package. Due to the deficiency of service from the opposite party complainant caused huge loss and mental agony. Therefore complainant is seeking relief against opposite party to direct them to pay a compensation of Rs.25000/-.

 

            After sending notice to opposite party it was returned with endorsement addressee left. Complainant continuously absent for the last 3 consecutive postings. On perusal of complaint it shows that some of the channels are not access with the HD DTH digital new channels added but it was not access with the digital. Only the receipt is produced, that was not improve the complainant’s case. So in the absence of any other evidence no merit in this complaint. Therefore complaint is liable to be dismissed.
